1. Acceptance of Terms
By accessing or using the services provided by DrSoft SRL ("DrSoft", "we", "us"), you agree to be bound by these Terms of Service. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree, do not use our services.
2. Description of Service
DrSoft provides proxy infrastructure services including, but not limited to, residential proxies, datacenter proxies, mobile proxies, and related API access. Our services are designed for legitimate business use cases such as web scraping, market research, ad verification, SEO monitoring, and brand protection.
3. Acceptable Use
You may use DrSoft services for lawful business purposes, including:
- Public web data collection and aggregation
- Price monitoring and competitive intelligence
- Ad verification and brand protection
- SEO rank tracking and SERP monitoring
- Market research and academic research
- Application testing and quality assurance
4. Prohibited Use
The following activities are strictly prohibited when using DrSoft services:
- Any activity that violates applicable local, national, or international law
- Ad fraud, click fraud, or impression fraud of any kind
- Sending unsolicited messages, spam, or bulk communications
- Unauthorized access to systems, networks, or accounts
- Distribution of malware, viruses, or other harmful software
- Scraping or collecting personal data in violation of GDPR or other privacy regulations
- Circumventing access controls on systems you do not own or have authorization to access
- Any activity intended to harass, threaten, or harm individuals or organizations
DrSoft reserves the right to suspend or terminate accounts engaged in prohibited activities without prior notice and without refund.
5. Ethical Use Policy
DrSoft is committed to ethical proxy use. Our infrastructure is intended for legitimate business operations only. Clients are responsible for ensuring their use of our services complies with all applicable laws and the terms of service of any websites or platforms they access through our proxies. We actively monitor for abuse and cooperate with law enforcement where required.
6. Payment Terms
All fees are as stated on our pricing page or in your service agreement. Payments are due at the beginning of each billing cycle. We accept major credit cards and other payment methods as listed on our website. All prices are in US Dollars unless otherwise specified. Unpaid invoices may result in service suspension after a 7-day grace period.
7. Termination
Either party may terminate the service at any time. You may cancel your subscription through your account dashboard or by contacting support. DrSoft may terminate or suspend your account if you violate these terms. Upon termination, your access to the services will cease immediately. Any prepaid and unused credits are subject to our refund policy.
8. Limitation of Liability
To the maximum extent permitted by law, DrSoft SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of our services. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.
9. Service Availability
While we strive to maintain 99.9% uptime, DrSoft does not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors beyond our reasonable control, including network outages, third-party service failures, or force majeure events.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Romania and the European Union. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Romania.
11. Changes to Terms
DrSoft reserves the right to update these terms at any time. We will notify active users of material changes via email or through a notice on our website. Continued use of the services after changes take effect constitutes acceptance of the revised terms.
